Limited Warranty Policy

Subject to the terms and conditions below, ElectroSea, LLC dba Magnevo Pumps (“Magnevo”) warrants that the Magnevo product listed below (the “Product”) will be free from defects in materials and workmanship for the applicable warranty period specified for that Product in the table below from the purchase date when used for its intended purposes under normal usage conditions (as described in the Product documentation). As described below, there are limitations to this Limited Warranty.

Who is Covered: This Limited Warranty is available only to the purchaser of a Product directly from Magnevo or an authorized Magnevo dealer (the “Original Purchaser”) and is not assignable or transferable.

The Warranty Period: This Limited Warranty applies only to warranty claims received by Magnevo within the applicable warranty period for the Product that is the subject of the warranty claim (the “Warranty Period”). or each Product, the Warranty Period begins on the original purchase date and continues for the period specified for such Product in this Limited Warranty.

How to Make a Claim: Email Magnevo at support@magnevo.com. You must make your claim during the Warranty Period and within 30 days after you first discovered the defect that is the subject of your claim. Please provide in the email a receipt (or similar document) that demonstrates that you are the Original Purchaser and your claim was made within the Warranty Period. You will also need the Product’s model, serial number, and a written description of the defect, including when the problem first occurred. Magnevo may require that you send the Product to Magnevo, at your cost, for examination. Magnevo will inspect any Product submitted for a timely warranty claim to determine if the failure was the result of a Product defect. If Magnevo’s inspection determines, in Magnevo’s sole discretion, that damage was caused by (i) ordinary wear and tear, (ii) modification, (iii) abuse, misuse, or mishandling of the Product (including but not limited to new installations or applications), (iv) improper installation, (v) failure to follow Product instructions, (vi) jamming or clogging with foreign matter, (vii) use of chemicals or other substances not expressly specified by Magnevo for use in or with the Product, (viii) repair or modification of the Product by someone other than Magnevo, (ix) damage while in transit, (x) damage as a result of neglect or improper maintenance, (xi) operation outside of published limits, including excessive pressure, temperature, speed, dry-run conditions, or chemical incompatibility, or (xii) the inspection is inconclusive, Magnevo will have no obligation with respect to the Product, including but not limited to an obligation to honor the Limited Warranty or to return the Product to Original Purchaser. In such event, you may arrange to pick up the Product at your sole cost and expense.

If Magnevo determines your claim is covered by this Limited Warranty, at Magnevo’s sole election, Magnevo will take one of the following steps: (a) pay you a refund (not including shipping costs, taxes, or other fees), (b) repair the Product, or (c) send you a replacement Product (which may be a new, refurbished, or remanufactured unit of equivalent functionality). Any repaired or replacement Product will be warranted only for the unexpired portion of the original Warranty Period, or thirty (30) days from the date of repair or replacement, whichever is longer.

This is the sole and exclusive remedy available under this Limited Warranty. Magnevo’s maximum monetary liability under this Limited Warranty is an amount equal to the purchase price paid by the Original Purchaser for the Product. Magnevo will have no liability or responsibility for damage to equipment connected to, installed with, or used in conjunction with any Product.

Limitation of Damages: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAGNEVO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO THE PRODUCT OR THIS LIMITED WARRANTY, EVEN IF MAGNEVO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

No Other Warranties: This Limited Warranty is the only warranty that applies to the Product. Magnevo has not given anyone the right to make any representation, warranty or promise of any kind relating to Magnevo or the Product, so if someone other than Magnevo makes a warranty or promise relating to Magnevo or the Product, that warranty or promise is not binding on Magnevo. Magnevo does not authorize its employees or agents to make any representation or warranty with respect to the Product or potential applications of the Product, whether oral or in writing. MAGNEVO EXPRESSLY DISCLAIMS ANY OTHER WARRANTY, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCT, INCLUDING BUT NOT LIMITED TO ITS QUALITY, PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, MAGNEVO EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY REGARDING SPECIFIC PRODUCT PERFORMANCE.

EXCEPT FOR THE EXPRESS LIMITED WARRANTY SET FORTH ABOVE, THE PRODUCT IS PROVIDED “AS IS” AND “AS AVAILABLE.”

Product Changes: Magnevo may change the Product, the materials used in the Product, or the manner in which the Product is made from time to time but will not have an obligation to incorporate any of those changes into previously manufactured Products or provide notice of any of those changes to purchasers of previously manufactured Products.

When you provide Magnevo information relating to a claim, you are providing your consent to collect, store, use, and share that information in the manner specified in our Privacy Policy.

All sales are subject to Magnevo’s Standard Terms and Conditions, which may affect your rights under the Limited Warranty and are available online.
